Affiliate agreement

1. The parties and joining

This agreement binds PAPEL SAS, a company with share capital of €100, registered with the Paris Trade and Companies Register under number 843 729 864, registered office 58 rue de Monceau, 75008 Paris, EU VAT number FR18843729864, which publishes Please Send It ("PAPEL"), and any adult holding a Please Send It account who joins the affiliate program ("the affiliate"). Joining is free. It is done online, by checking the box accepting this agreement; the accepted version, date and time are recorded. This agreement supplements the Terms of Use.

5. Confirmation after 30 days

Each commission is first "pending". It is "confirmed" 30 days after the customer's payment, if the payment has been neither refunded nor disputed. A refund cancels the corresponding commission, or reduces it proportionally if partial; a payment dispute (chargeback) cancels it. Only a confirmed commission is due.

Personally earning money for getting one's employer to choose a supplier, without the employer's consent, may constitute private bribery under French law (article 445-2 of the French Criminal Code). Therefore, when the customer brought in is the affiliate's own organization (they are a member of it, or their professional email address has the same domain name as the customer's, excluding consumer email services), the commission is not paid to them: once confirmed, it becomes a discount on that organization's subscription.

As an exception, the commission is paid to the affiliate if they declare, in their affiliate dashboard, that they have their employer's written consent. The declaration is time-stamped and applies to future payments; the affiliate guarantees its accuracy, and PAPEL may ask for a copy of that consent. Recommending the service to other companies, customers or partners remains allowed, subject to the affiliate's employment contract.

8. Payment

The affiliate chooses one of these three ways to be paid in their dashboard, and can change it at any time for commissions not yet paid:

Confirmed commissions are paid by bank transfer at the start of the month following their confirmation, and, for bank transfer against an invoice, once the invoice is received. PAPEL reports to the tax authorities the amounts paid to a given beneficiary when the law requires it (DAS2 return, above €2,400 per year). The IBAN is stored encrypted and never shown in full in the affiliate's dashboard.

10. Refusal and removal

PAPEL may refuse a membership, or remove an affiliate who does not comply with this agreement, by a reasoned decision sent by email. Upon removal, the link and the code stop working and commissions still pending are canceled; commissions confirmed before the removal remain due, except in case of fraud.

11. Term and changes

The agreement is entered into for an indefinite term. The affiliate can leave the program at any time by writing to support@pleasesendit.com or by deleting their account: confirmed commissions remain due, unless they have already been converted into credit. PAPEL may change the agreement or end the program by announcing it by email at least 30 days in advance; commissions on payments collected before the effective date remain due.

12. Independence

The affiliate acts independently. The agreement creates no employment contract, agency or partnership between the parties, and the affiliate cannot bind PAPEL.

13. Personal data

The data needed for the program (code, clicks counted without any IP address in the clear, linked customers, commissions, payment details, invoices) is described on the Your data page, with its retention periods.

14. Governing law

The agreement is governed by French law. In case of disagreement, the parties first seek an amicable solution. Failing that, the competent courts are those of PAPEL's registered office when the affiliate acts in a professional capacity; a person acting outside any professional activity keeps the jurisdiction rules that protect them.
